Domestic Violence

Domestic violence is an umbrella term that describes a number of different charges in Oregon. Crimes such as assault, battery, abuse, or stalking could all be considered domestic violence when the defendant and victim live together or are related. A conviction for a domestic violence crime can have lasting and serious repercussions; if you have been charged with a domestic violence crime, it is imperative that you have an experienced defense attorney working on your behalf.

Major Felonies (Measure 11)

In 1994 Oregon passed Ballot Measure 11. This was a ‘tough on crime’ law that established harsh minimum sentences for certain felony crimes. The so-called “measure 11” crimes include murder, manslaughter, assault, kidnapping, robbery, rape, and sexual abuse. The minimum sentences for these crimes range from 5 years for second degree robbery to 25 years for murder. Regardless of the facts of a case, a judge can’t sentence a person to less time than this law says. Moreover, parole and time off for good behavior are not options for these crimes.

Restraining/Stalking Orders

In Oregon, a restraining order is available to you if you have been the victim of domestic abuse or if you fear you will be a victim. The Family Abuse Prevention Act, or FAPA, allows for protection from abuse while you are going through a divorce. It is important to fully understand what you are asking for when you seek FAPA protection and if you are the recipient of a FAPA restraining order, you must fully understand and comply with the orders you have received.
